Our goal at AP Race Plus Limited, a company registered in England and Wales under company number 12629959, with registered office at 20-22 Wenlock Road, London, N1 7GU. ("we", "us", "our") is to make your purchasing experience easy, efficient and equitable, so we can get you competing as soon as possible. This Purchase Policy is designed to ensure your satisfaction and understanding of the purchase process on the AP Race Plus Site. This Purchase Policy incorporates our Terms of Use by this reference.

1. INTRODUCTION

1.1 This "Purchase Policy" sets out the terms and conditions applicable to any purchases you make from AP Race Plus. If you are making a purchase online, this Purchase Policy also incorporates our Terms of Use.

1.2 We offer a subscription based service for content on our Site and associated products.

1.3 In this Purchase Policy, we refer to any products and services offered for sale by us (including the above mentioned) as "Items".

1.4 Our Purchase Policy does not apply to any purchases made from any other third parties. If you have any queries or complaints regarding your purchase of items from third parties, please contact them directly.

2. CONTRACT

2.1 In order to make a purchase from AP Race Plus, you must have a AP Race Plus account and a valid credit or debit card issued in your name. You must also meet our Country Age Requirements in our Terms of Use. We use Stripe as our payment processor on our Site. We use ‘Secure Socket Layer’ technology (SSL) to encrypt your payment, to ensure your card details are safe. Verified by Visa and Mastercard SecureCode (3D Secure) is also in place where set-up by you, to provide further security. You can identify a secure connection when the usual ‘http’ page address prefix changes to ‘https’. You may also see a small padlock icon indicating that the page is secure, depending on the Internet browser you are using.

2.2 Any purchase from us is subject to this Purchase Policy.

2.3 Your contract for purchase starts once we have confirmed your order and the re-occurring subscription payment is taken each month thereafter until the you decide to cancel your renewal.

2.4 All purchases are subject to credit or debit card verification (if applicable), other security checks, and collection of payment by us. Your order may be cancelled if it has not passed our verification process or if payment is not received in full. In this case, you will receive an email notification to notify you.

2.5 It is prohibited to obtain or attempt to obtain any Items through unauthorised use of any robot, spider or other automated device or software, or any other illegal or unauthorised activity. We reserve the right to cancel any order(s) that we reasonably suspect to have been made fraudulently or otherwise in breach of this Purchase Policy, without any notice to you, and any and all Items obtained as part of such order(s) will be void.

2.6 To prevent fraud and protect AP Race Plus, we reserve the right to carry out checks and/or request that additional information be provided in order to verify purchases. We may cancel orders which we reasonably suspect to have been made fraudulently.

2.7 Subscriptions may be paid for on a monthly or a yearly basis. If purchased for a year in advance, you will benefit from a small discount.

3. PRICES AND FEES

3.1 All prices for Items offered for sale from us are inclusive of VAT where applicable.

3.2 Whilst we try to ensure that all advertised prices are accurate, errors may occur. If we discover an error in the price of any Item you have ordered, we will inform you as soon as possible and give you the option of confirming your order at the correct price (in which case we will credit or debit you as applicable) or cancelling your order (in which case you will receive a full refund). If we are unable to contact you to confirm your order at the correct price, you agree that we may treat the order as cancelled and issue you with a full refund.

4. DELIVERY

4.1 There will be no physical delivery, email confirmation will be sent upon confirmation of payment. This must be retained as your proof of payment as well as your order number. You will be able view your billing history in your account and download a PDF statement.

5. YOUR RIGHTS IN RELATION TO EVENT CANCELLATIONS AND ALTERATIONS

5.1 If you make a subscription, you may change your mind for any or no reason and receive a full refund of the subscription within fourteen (14) days starting from the day you sign-up for the Services provided you have not viewed or streamed any content on the Site.

5.2 Cancellation: If you wish to cancel your subscription, your access to the content will end at the end of your subscription period. This subscription period starts on the date of subscription and ends either 1 month after (if on monthly billing) or 1 year after (if on yearly billing). You will not be provided a refund, you will simply be cancelling your renewal.

5.3 Refunds will be made using the same means of payment as you used for the initial purchase.

5.4 Exceptional circumstances may be taken into consideration if a user needs to cancel and obtain a refund. In this situation please contact us. We reserve the right to refuse such requests.

6. QUERIES AND COMPLAINTS

6.1 If we need to contact you, we will use your contact details provided at the time of purchase. It is your responsibility to inform us of any changes to your contact details, both before and after purchase. Particularly, please ensure that you provide us with a valid email address as this is our preferred method of contacting you. You should also be aware that your email mailbox settings may treat our emails as junk, so remember to check your junk and/or spam folders.

6.2 If you have any queries or complaints regarding your purchase, please contact us, quoting your order number or registration email.

6.3 If any dispute arises, we shall use our reasonable endeavours to consult or negotiate in good faith, and attempt to reach a just and equitable settlement satisfactory to you and us.

6.5 Although this does not restrict your rights to pursue court proceedings, if we are unable to settle any dispute by negotiation within 28 days, you and we may attempt to settle it by mediation. To initiate a mediation a party must give written notice to the other parties to the dispute requesting a mediation.

7. GOVERNING LAW

7.1 We and our affiliates, successors, or assigns may enforce these terms in accordance with the provisions of the Contracts (Rights of Third Parties) Act 1999. Except as provided in the previous sentence, this Purchase Policy does not create any right enforceable by any person who is not a party to it, but does not affect any right or remedy that a third party has which exists or is available apart from the Contracts (Rights of Third Parties) Act 1999.

7.2 All of the terms and conditions of this Purchase Policy are governed by English law and any disputes arising out of or in connection with any order (including non-contractual disputes and claims) are subject to the exclusive jurisdiction of the courts of England and you irrevocably submit to the jurisdiction of the courts of England.
